Why wait 19 years for six months?

After nineteen years of wait the courts say that though DGP Rathore is guilty of molesting a child but let bygones be bygones. Their judgement indicates that though Rathore was wrong but what the hell? He didn’t really rape the kid. Did he? Moreover, the kid has been long dead and so whose justice are we talking about in any case? The person who deserved justice is not there. So just forget it and move on. That’s what the courts imply. It is for this very reason that the special magistrate of CBI court J S Sidhu granted him bail too so that the poor DGP who has undergone a very harsh trial for nineteen long years does not suffer anymore. And Rathore was relieved for sure. May be that’s the reason why he was laughing when he came out of the court. And besides, since he made an absolute fool of the law for such a long time he was damn right in laughing away to glory. Shameful, to say the very least.

What stupid laws we have in our country! Laws which are broken by the very people who are supposed to protect it. And the stupid law keeps watching helplessly. Actually, it doesn’t even watch because it’s bloody blind. And deaf, mute and crippled as well. If you have such a crippled law to deliver justice, what else can you expect? No wonder the darn thing took nineteen years to deliver, a warped sentence, I might add. Fact is that the law itself is warped as far as molestation of kids is concerned. Under the present laws a person can be sentenced to a maximum of two years for molestation. It does not specify anything about molestation of a child. Or probably, magistrate Sidhu thought that two years is meant for molestation of a full grown woman and therefore by an extension for a child six months of sentence is enough. It is another matter that Law Commission has indeed recommended that this law be changed but that recommendation was made in 2000 and it’s still gathering dust. Talk about inefficiency. HUH!!

Yesterday, I watched Arnab Goswami on Times Now and Nidhi Razdan on NDTV discussing this case with some panelists. Both of them were quite vociferous in asking for a stricter sentence. While that was in order they also questioned as to why wasn’t he charged with abettment to suicide? Fact is that this man was indeed charged with abettment to suicide but the High Court had quashed this charge. And in my opinion it was correct in doing so. Ruchika did not commit suicide because of molestation alone. Had that been the case she would’ve done it immediately after the incident when her trauma was maximum, not after three years. She committed suicide because of not just the molestation but because of the harassment which she and her family had to face because of the charges which they had filed against Rathore. She was thrown out of school, her brother was beaten up and put in jail on trumped up charges, her father was threatened and her house was assaulted by hired goons of Rathore. It’s because of all this that she thought that she was the reason behind their problems and committed suicide. Now, if these charges were to be proved in court then alongwith molestation the charge of abettment to suicide would hold and then Rathore could’ve been put behind bars for a maximum of ten years. Not otherwise. It was entirely up to the lawyers to prove the charge of harassment. I really wonder why they did not. The next question which arises is as to how and why Rathore was promoted to the rank of DGP by Om Prakash Chautala who was the CM at that time, when there was a charge of molestation pending against him and why wasn’t he sacked by successive govts of Haryana? Or is it that molestation is too small a thing to be bothered about especially when you are talking of such a senior police officer? Or is that it is difficult to remove such such senior officers because they are the ones who do the dirty job for politicians and are therefore both partners in crimes? And how can you expect one partner to betray the other, especially since they hold each other’s dirty secrets?

The third question which comes to mind is- On what grounds was a serving Inspector General of Police made the President of Haryana Lawn Tennis Association? Was it just because he played tennis or did he have any other quality as well? The very fact that Haryana has not produced any tennis player worth mentioning goes to prove that neither did he have any organizing capability or any other special attribute to justify this appointment. It reminds me of KPS Gill who presided over the demise of Indian hockey as President of Indian Hockey Federation while he himself was busy bottom pinching Rupan Deol Bajaj. Well, neither did Gill get any jail sentence and nor did Rathore. Did they say justice delayed is justice denied? They should instead say- Be thankful that Justice has been delivered, whenever it is.

The last and the most important question which we need an urgent answer for is how did Rathore manage to delay a plain open and shut case where we had an eyewitness for nineteen long years? Why was he allowed to transfer the case three times to three different cities to suit his own will and disposition? If such a simple case takes nineteen years to deliver a warped judgement what can we expect from such a system? Isn’t it amply obvious that there was a nexus between police, politicians, lawyers and judiciary as well? Veerappa Moily, our Law Minister, would do well to start making amends for our archaic laws which benefit the powerful and wealthy which we keep seeing, oh so regularly.

I really wonder why they depict law as blind woman holding the scales. May be they should change it to show a whore who delivers only when paid. Or may be not because a whore does not necessarily pretend to be anything else like our law who pretends to deliver justice. May be they should have a picture of a blind pimp instead who has no qualms in selling to anyone who gives the maximum price. Like the famous American author William Gaddis said-

“You get justice in the next world, in this world you have the law”.

While are talking about this case it would be in order to speak about Mr Anand Prakash and his daughter and Ruchika’s friend Aradhana, who single handedly defied all odds and fought this case. In fact, Aradhana is now living in Australia and has come to India like on many other occasions to see that justice is delivered for her long gone friend. They have fought the law of the land for nineteen long years and are still ready to take this case to it’s logical conclusion. It is people like them who re-instill our faith in humanity, love and care. Hats off to this family and MAY GOD BLESS THEM!!!!

    Judiciary is also as corrpt as police or our politicians. they r all in this together to make money and satisfy their filthy urges.

    In this country where it is entirely the prerogative of the law enforcing agencies to break the law, the best thing people with a human heart can do is to isolate Rathore socially. Don't his relatives and friends have girl children? What do they think about this?

    May it be Judiciary or any Govt. Inc., I believe all are suppressed or fear of their superiors. Congress has always suppressed this country since the day one of our independence and never allowed the poor or the pity citizen to take charge of their rights. This is what exactly has happened in this case. Out of three pillars for our nation, politics rules others. Judiciary is bound with the laws which are made and passed by illiterate self centered & C-grade people in our society. How can we expect any better judgment in our system ?

    Hi Sush,
    A well written blog, as usual of you. To post any thoughts on the issue now would invite a death warrant. Nevertheless, why Rathore alone? Beginning from her school, her teachers, her principal, the then police, media, court, judges, politicians and eventually the chief minister all should be charged with culpable abettment to homicide. To point out that Rathore alone was the evil of all that transpired in Ruchika's life is to let away an entire syndicate who were directly and indirectly contributing their share of indulgence to the doom of the girl and her family. If justice has to be done, bring all those who are involved - if not it would appear to be an unsuccessful mission of delivering justice already denied for 19 long years!

    I really wonder on what grounds are Lalus and Mulayams protesting against the Women's Bill. Their argument, is unconvincing and shaky. Even ideally, if for a moment, we think that poor Dalit women were to be indeed elected I'd damned if our highest governing bodies were to be made up of women who are absolutely illiterate and work as maids or do some such menial jobs. I really do not have anything against them but they do not have the aptitude or ability for this job, not as of now at least. As for my maid, I'm thankful to God if she completes my household chores satisfactorily, leave aside managing the country. .....
